The following terms and conditions (Hereinafter “Agreement”) apply to the purchase of goods and/or services on the website located at https://aceshockeyacademy.com and all associated platforms therewith (hereinafter “Website”). As a condition of using the Website to purchase or sell admissions, the following written Agreement must be accepted by you as the Purchaser, prior to completing any transaction.

GENERAL TERMS

Parties

The parties to this Agreement are you, the Purchaser (hereinafter “Purchaser; you”) and Aces Hockey Academy, a Colorado based education and sports company (hereinafter “Aces; we; us”).

Scope

The scope of this Agreement shall cover the Purchaser’s online interactions with the Website including, but not limited to, the purchase of programs, events, courses, or get togethers.

Jurisdiction

This Agreement and associated use of the Website shall be governed by and construed in accordance with the laws of the State of Colorado. You agree that any action at law or in equity arising out of or relating to this Agreement shall be filed only in accordance with the terms set forth herein, or, in the absence of such terms, in the state and federal courts located in the City and County of Denver, Colorado. You, as Purchaser, do hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts in any suit, action or proceeding arising out of this Agreement.

Statute of Limitations

Any cause of action by Purchaser with respect to this Agreement must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

Dispute Resolution

If a dispute arising from this Agreement should arise, the parties agree to use alternative means of dispute resolution (mediation, arbitration, etc) before filing a grievance with a court of proper jurisdiction in a manner outlined in this Agreement. Should no such outline exist, the recommended practices of the Colorado Office of Dispute Resolution shall be used as guidelines.

Severability

If any provision of this Policy shall be deemed unlawful, void or for any reason unenforceable, then that provision shall not affect the validity and enforceability of any other provisions. Furthermore, a new provision shall automatically be deemed added to this Policy in lieu of such illegal, invalid or unenforceable provision, which new provision shall be as similar in terms to such illegal, invalid or unenforceable provision as is possible with the new provision still being legal, valid and enforceable. Aces’s failure to enforce any provision of this Policy shall not be deemed a waiver of such provision nor of the right to enforce such provision in the future. No waiver by Aces of any provision of this Policy shall be effective unless in writing.

Changes To This Agreement

Aces may change this Agreement from time to time and in any manner in Aces’s sole and absolute discretion. Any such change shall be effectively immediately upon the posting of the amended Agreement on the Website, and no notice of any such change shall be required for such amended Agreement to be effective.

PURCHASE, REFUNDS AND RETURNS POLICY

This Purchase, Refund and Return Policy (“Policy”) applies to refunds and returns associated with the access to and use of the Website.

Purchasing From Aces

Aces acts as an agent between those who organize events, venues, teams, artists and clubs, promoters and leagues (collectively, "Organizers") and those who purchase admissions, registrations, sign-ups, services, and products (collectively, "Athletes").

Event Purchases

All Aces purchases are final, except as otherwise provided on the website. Purchases begin when you have acknowledged your consent to and electronically signed the Agreement and have otherwise provided all other information and documents required by Aces.

Indemnity

When purchasing event admissions, registrations, bookings or other services (hereinafter “Programs”) the Purchaser fully assumes the responsibility for any and all losses incurred as result of attending any event, festival, grounds, or facility to which your Program provides access or use and indemnifies Aces and any affiliated organizations from all liability associated with said attendance.

Event Refunds and Returns

Please carefully review your purchase before providing payment information. All fees and other amounts paid to Aces under the Agreement are non-refundable. Returns for Aces services, products, and apparel, which may include, without limitation, registration fees, tickets, t-shirts, hats, physical equipment, electronic equipment or other physical or tangible products cannot be returned.

Pricing and Other Errors

If the amount you pay for a Program is incorrect either due to an error in the Website or information provided by an Organizer, then Aces has the right to cancel the Program(s) and issue a refund or a difference for the amount paid.

Program Resale

Programs cannot be resold, canceled, or transferred by the customer without expressly written consent from Aces Hockey Academy. Aces does not guarantee the authenticity of programs purchased from any non-authorized third party reseller.

No Cash Value

Programs cannot be redeemed for cash value.

Event Cancellations or Changes

In the event that an event Organizer cancels, delays, or significantly changes an event, Aces will attempt to contact you to inform you of refund or exchange procedures. If the event is canceled and you purchased your Program(s) through aceshockeyacademy.com, you will be automatically issued a refund to the payment method that was used to purchase the Program(s).

Refusal of Admission

Organizers can refuse admission or eject any athlete due to disorderly behavior, or failing to comply with the rules set out by the Organizer. Aces Hockey Academy assumes no liability for Organizer terms, rules, and/or regulations. Breach of Organizer terms, rules, or regulations will terminate the Program without refund.

Chargebacks and Payment Disputes

Purchaser hereby waives the right to initiate a chargeback or dispute for any reason. Attendance of any Program or other type of event shall be considered prima facie evidence in favor of Aces should the Purchaser initiate a chargeback after any event, for any reason. Such evidence may be deemed relevant regardless of said chargeback’s subsequent categorization.

Aces provides this privacy policy ("Policy") to inform you of:
(i) the types of information we collect;
(ii) your choices surrounding such information; and
(iii) how we collect, use, share, update and protect such information.
This Policy applies to customer information obtained in connection with your access to and use of the Website. This Policy does not alter in any way the terms or conditions of the Agreement. Aces is committed to maintaining your privacy, providing you with information and choices, and permitting you opportunities to correct inaccuracies. Information We Collect

We collect information you provide directly to us. By way of example and not limitation, we collect information when you create an account or profile; use the interactive areas and features of our Website; make a purchase or rental; sign up for contests, promotions or mailing lists; and when you email, call or otherwise communicate with us. (i) account information, such as your name, address, phone number, fax number, email address, photos, social media usernames, demographic information and information about your interests and preferences; and
(ii) transaction information, such as your name, billing address, shipping address, phone number, email address, credit card information and transaction history.

In the event you do not wish Aces to receive your location information, you have the ability to turn location-based services on and off by adjusting the settings of your mobile device, or by following the standard uninstall process and removing all Aces applications from your mobile device.
